Threat of legal cost with claim in Money Claim Online
I am dealing with an issue involving a large unregulated organisation. I have brought a claim through the money claim on line system. The other side has spent thousands on a defence involving a barrister and have filed an action to strike out threating me with their legal costs.
This seems a clear abuse in trying to use legal costs to get me to withdraw & also not following the money claim on line process to get to resolution, i.e. just file defence and deal with issue through small claim process rather than a very expensive defence + action to strike out.
Re: Threat of legal cost with claim in Money Claim Online
There are some complexities but at the simple level as filed it is claim to have an invoiced cost being declared as not due plus recovery for expenses where an agreed to service was not provided.
The total claim was for about £1,500 and expressly limited to under £5,000.
