    Default Glasgow City Council-Double yellow lines - No PCN

    I was parked on Double yellows for 10 mins on a Saturday night in July 07 @ 8.30pm. I didn't think that wardens worked at that time of day! To cut a long story short, the ticket was not on the car when I returned and the only notification was a letter demanding £90. I did not receive any communication until this final letter.
    I complained to the council advising them of these facts requesting a copy of the pcnicon. They very kindly noted my comments but said tough;due to the adminicon processes within their office, they could not provide me with a duplicate. Further, they state failure of post being delivered lies between me and the Royal Mail and no further correspondence will be entered into!
    This is legalised extortion. can anything be done?

    Quite a bit can be done.

    I think that you can probably claim that you were not served, unless Glasgow have gotten powers to issue tickets via cctv in which case the PCN will have been sent to the Registered Keepers address.

    Was the letter you were sent a notice to owner?

    There a quite a few threads on these forums about PCNs and the lies/half truths you will be told by council officials.

    Glasgow Council operate decriminalised parking under the 1991 Road Traffic Act. You should be able to obtain a copy of the PCN under the freedom of information act. You will need to make a Subject access requesticon.

    Have a read of this thread. It may help shed some light on what to do.

    You are confusing FoI and DPA. Subject access requesticon is for DPA

    The notice to owner has the same information so it does seem a bit pointless wasting time and effort to get a copy of the pcnicon.

    except the NtO wouldnt contain the " you are therefore required to pay ....." if it was contained within the PCN

    this statement has been held to be incorrect and misrepreseniting the legal position, in fact i have had 7 tickets cancelled on this point , every time i try to get it before the Adjudicator i submit my representations and they cancel the ticket (surprisingly)

    so it would be good to get a copy of the PCN

    thats my opinion anyway

    Thanks for the replies. The first I was aware of this was from the charge certificate dated 19/11/07. No notice to owner.

    You will need to make a statutary declaration stating you didn't get the NTO and it will revert back to that stage.

    Thanks Greenandmean. What is required within the statutory declaration? Is there a particular form to collect and fill prior to submitting to the council?
