    Default Bank Holiday Entitlement

    Hi
A bit of advice needed if anyone can help.
I currently work 4 days out of 7 no set days off just as per rota.
Where I work have decided that if im not working on a bank holidayicon im not entitled to it as a Bank Holiday ie its just classed as a day off.
I could appreciate this if say I did not work Mondays for instance but i have no set rota
Any one any idea where I stand on this?
    Thanks in advance

surely if you are not employed full time, then you cannot get every bank holidayicon added to whatever your agreed holiday entitlement is?

unless of course they are forcing you to use a paid holiday entitlement for a bank holiday.

Sadly, employers are under no obligation to let ANYONE have bank holidays off of work. It's entirely at their discretion. This is how most firms got around the recent increase in statutory holidayicon pay. Instead of actually increasing everyone's entitlement to 22 days, they merely stated that the extra 2 days are used up on bank holidays.

Annual holidayicon must total at least 4.8 x your normal working week, therefore your annual leave entitlement is 19.2 days. This can include the 8 public holidays each year.

You say that bank holidays are just 'a day off', but don't make it clear whether this is a day with pay but not worked, or a day taken from your holiday entitlement, or a day off with no pay. If I am right, I believe that you are saying that there are weeks where you are only getting 3 days work (and therefore 3 days pay) in a week where you would have been rota'd to work on the Monday but the business is closed. Providing that you get at least 19.2 days each year to take as holiday, for which you are paid whilst being off, then this covers the bank holidays where you are closed and have a short week's pay as a result.
