    Default Bailiff - NOTICE OF REMOVAL

    Hi, just got home to find a nice BIG red letter from JBWicon Enforcement Ltd stating that I'm due a visit from them to collect a car which has an unpaid parking fineicon from January 2007.

    A few things; the car was a lease car from my previous employment whom I know longer work for hence I know longer have the car. They say they have visited my house but have NEVER left anything to say that they've called or have I recieved any other letters from them.

    Most importantly, I'm not even aware of the ticket in the first place!

    Advice please,

    1. What would happen if I don't pay it?
    2. As its over a year since the date of the ticket, does this help me?
    3. What can they LEGALLY take if they can't have the car?

    If you don't answer your door each time they call then the case is eventually handed back to the authority that originally issued the ticket.

    If you open your door to a bailifficon and he puts his foot into the aperture stopping you from closing it, then its said the bailifficon had gained entry to your home peacefully. bailiffsicon call this crossing the threshold. Once peaceful entry is made, they can take anything they think is yours. They aren't interested in household goods and consumer electronics, they just want the money, car or goods of monetary value.

    If you keep all windows and doors locked then the parking ticketicon will probably come to nothing. Many tickets usually do.

    You have said JBW is collecting a fine, is JBW pretending to collecting a fine and its just a parking ticket? or has a magistrate or judge sentenced you to pay a fine. Theres a big difference between a penalty charge and a fine, and if the former is true then JBW is committing a criminal offence under Section 2 of the Fraud Act 2006.

    Can you send me by PM ONLY the name of the bailifficon on the paperwork.

    Can you find out the pcnicon number. JBWicon should be able to provide this.

    Once you have this you need to call the Traffic Enforcement Centre to ask them the date that the warrant was authorised.

    The TEC's search facility requires the PCN number. Can you also confirm with them the name and address on the warrant.

    I suspect that this PCN was recorded in the name of your previous employer.

    Once you have the above, I can respond.
