Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hi my name is Becky and since i was 18 i have had these debts with a few companys .. these have now been passed to Fradrickson International and Connaught Collections who are collecting for what i know to be the same debt and also Aktive Capital and Howard Cohen who are also collecting for the same debt! I have asked these companys for the original credit agreement as i believe this to be my right and fredrickson say they do not have it and they do not need to provide me with it but they will try and track it down for me, Connaught have past the debt on and i have not heard from the others .... what do i do from here? I need some help as these companys are really nasty!! xxx
Re: I need help with Debt Agencys and harrassment!
Hi Becky1982,
First of all try not to worry,(I know it is easier said than done) but you have come to the right place you will receive all the help and advice from the wonderful people here.
First of all when did you send your letter asking for the credit agreement?
Who is the original creditor ?
If they can't produce the original credit agreement then the debt cannot be enforced.
Do not speak to these people on the telephone, they tell lies and attempt to upset you, they do not have the right to harrass you. they have no rights to take your goods, visit your home, nor can they impose any penalties on you without taking you through the courts
Always refuse to answer any of their security questions, state simply "in writing only" when they call, then hang up. if you are more confident, you can use whatever means you wish, but the message should remain the same "I will not speak to you at any time on the telephone.
If you are with BT, you can use their choose to refuse service to block their numbers.
Regardless of what they may tell you they are obliged to provide you with a copy of the credit agreement, this proves they have a right to collect on the debt and that you are the actual debtor.
did you use the letter from this site?
did you include the £1 fee?
did you sign the letter with your usual signature?
