    Question lyall v style card

    My Story so far:
    04/04/2007 sent SARicon
    28/04/2007 sent reminder SARicon letter
    14/05/2007 phoned accounts - can not locate any record of me whatsoever!!!
    received statements - finally!
    21/01/2008 created spreadsheet after highlighting all charges
    22/01/2008 sent letter requesting refund of charges and interesticon of £529.13 withinin 14 days or court action Expect response by 05/02/08
    28/01/2008 Fob Off letter - acc is Store card NOT credit so OFT ruling is not valid.

    With this latest letter the wording is:
    Whilst I appreciate your comments, The Office of Fair Trading has restricted its investigation to credit cards and has not consulted with Style Financial Services in relation to other products, including store cards. As your account is a store card the charges are valid and will remain.

    Has anyone come across this argument before? How did you successfully challenge it?
    I'm looking for a couple of pointers just to add weight to my lbaicon giving them a further 7 days to will start court proceedings.
    Any help would be greatly appreciated.

    They are just trying to fob you off and make you doubt yourself. Send them lbaicon and stick to your guns. Arn't they little tinkers.............

    This interesticon - it isn't the 8% is it, as that can't be added on till you file at court. If it is don't worry, just my humble opinion, might be best to send them a 2nd prelim and take it from there.

    Hi lyall

    Just a detail, the OFT case concerns personal bank accounts, not credit cards. That, said, either way it does not impact store cards.

    You have given them warning - I would go straigt to court. Sally's point is a good one - you shouldn't really apply the 8% interesticon under s69 of the County Courts Act until you claim in court. However, I don't think it really matters enough to start the claim again.

    If the interest you have claimed is not the 8% s69 interests, then don't forget to add that to your claim when you file in court.
