Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
hello,
i had a loan with Egg which i defaulted on and got passed to a debt collection agency.i managed to pay off the loan with them last year.
how do i get them to remove the default notice from my credit history.
thanks
The Default Notice is the legally required precursor to debt collection, which credit card institutions choose to publicize via Experian, Equifax etc. Clearing your debt which precipitated the DN does not, I believe, place an obligation on Egg to remove said DN. Legal experts will no doubt clarify this.
Egg are however obliged to notify Experian etc that your debt has been satisfied in total, which is a mitigating point in your favour. Experian will be obliged to add said debt satisfaction onto your file. After the passage of 6 years DN like CCJ will drop off a credit record.
Post Sub-prime and Northern Rock, with lending institutions now in dire trouble, even those with comparatively good credit history may not find it easy to get credit now, if that makes you feel any better. On the Channel 4 clip, HSBC was said to be rejecting 50% of new credit card applications currently (they used to accept around two in three), that's HSBC the biggest retail bank in the world.
You can only ge the default removed if Egg had no right to put it there. For example, because it is wrong (Amount wrong, wrong debtor, etc) or because the agreement regulated by teh CCA 1974 is incorrect in some way.
In your case, you have not hinted that either of these may be teh case, so I guess you will have to wait the 6 years as Mistermind says.
