Hi another Newbie here with MBNA credit card woes, and it's great to pick up advice given to those in similar situations.
I got here via google after I got the "We have been trying to contact you recently..." text message from the 01244 681461 number. Prior to that, I was getting calls from an 0118 9519500 number none of which I have answered or responded to. On one day, they called ten times!
Here's my situation. Credit card max'd out some time ago but haven't used it in years. Probably had the card ~9 years and the limit is ~£9K. I dread to think how much I've actually paid, but I was more or less keeping things at bay with regular monthly payments of £250. Somehow, before Xmas, a combination of charges and interest put the balance above the limit and then the hassle started. This has happened before, so I did the same thing - I up'd two monthly payments to £450, then, most recently £350, but this time, the hassle still continues. I'm waiting for my next statement to see how they've calculated that I'm still over my limit.
I'm kind of stuck and preoccupied and can't ever see this going away now. Even my sleep and concentration at work has been affected. Also, anything above £250 a month hurts quite a bit. Paying £450 in December certainly didn't put me in the festive spirit at all! Ideally, I need to get this back to a manageable situation where I'm not simply paying off their huge interest rates every month.
I guess I need to get the debt transferred to another company, especially as I don't think a balance transfer to another card is really an option. It's also something I'd prefer not to do.
Hopefully, I'm right in thinking the first step is the CCA letter, by registered post with the £1 cheque and take it from there with the whole 14 days + 30 days thing. I've been reading up on this, thanks to the excellent advice already given on this forum.
My understanding from reading posts here is that if I don't get the CCA within 14 days, then I can pay a much smaller monthly amount until the whole thing is resolved one way or another?
Any help, advice or encouragement gratefully received. I'll happily make a donation to the forum but you might have to wait till I next get paid!
It seems from what you have said that it is charges that have pushed your account over the credit limit. THe first thing to do is to get those charges repaid. Once youhave done that, you can consider moving the debt to another card.
Send MBNA a standard SAR (see bank templates library on the forum home page) with a £10 postal order. THis is a request under s7 of the data Protection Act 1998 for all information they hold about you. As your account goes back beyond 6 years I would add a bit in the letter asking them for all statements, not just those going back 6 years - you are entitled to this information under the Data Protection Act.
At the same time, you could also send them a "request under s78(1) of the Consumer Credit Act 1974 for a copy of the executed agreement for the account plus a statement of account as specified in the Act". Enclose a postal order for £1. print your name on the letter but do not sign it.

Thanks for the advice. Until I get a new statement, I can't really tell what's pushed it over the limit. Ultimately, I just want to get to a situation where I'm paying less interest and with manageble monthly payments. I really don't think getting another card is an option for me unfourtunately although I haven't tried yet. Trying to make the MBNA payments has resulted in my going over my overdraft limit
I was approached in Halfords tonight by a young woman about a special offer for a Halfords MBNA card. I told her what I thought about MBNA. pity, she was such a nice young lady
