    This is a long story but a family member has purchased a tv from currys which developed a fault 2 weeks after buying it , currys sent out there engineer who was in a bad mood and he insisted that it was her extension lead that was faulty and went away, so she went to currys who agreed to replace it, the new TV was being delivered today to the store so she collected it and took the old TV back with her she took the receipt to the collection door and they brought out the new TV the lad saw the old one in the van and didn't take it as she went to go back in the store a chap started having ago at her because she was parked on the pavement outside the main doors so she closed the door on the van and drove off she asked her husband what she should do with the TV and he said take it down the tip which she has done , what I am asking is if Currys want the TV back what should she say, I assumed that currys would not have refunded her for the old one without it being returned first.

    Well, if curry's do wan it back then the buyer has got a lot of explaining to do. They effectively have two TVs for the price of one. The damaged one should have been returned. Curry's will be entitled to ask for it back, or its cash value (less an amount for the damage which will be difficult to do).

    If it comes down to it, the only thing you can do is to try and argue that you weren't told to bring the old one into the store. However, legislaion does speak of restitutionicon of goods, and everyone is deemed to know legislation.

    I would head back down to the skip and hope its still there (and in one piece).
