Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I recently moved out a rented flat (30th April) and requested a home move through Scottish Power . I phoned them on or around the 27th April with my final readings and new address.
Recently I received a Final Demand bill from SP at my new address with an amount on it and no details. I phoned up to request a detailed bill so I knew what I was getting billed for.
On receiving the copy of the bill I noticed that I was being charged upto the 7th May with an estimated reading!
I phoned them to query this but they said they have no knowledge of the final readings I gave them. I find this stranage as I gave them the final readings during the same telephone call I gave them my new address and they managed to get my address ok.
Can they bill me for an estimated reading? Also, I dont have the final readings anymore, what can I do?
If they do not have a final read for the account then they will use estimated readings to close the account. These estimates should be based upon the average daily useage over the past 6 months.
Chances are that when you gave SP their final reads and forwarding address the agent you spoke to didn't enter them on the system or detail them in the account notes. Ideally you should have kept the final reads until you had received the bill.
You will need to contact SP firstly to query why the bill runs past your move out date and to get them to re-estimate the final reads based upon average daily useage. Using the average daily useage generally produces a more accurate estimate and can be compared to a similar period twelve months previous to verify the estimate. In this situation this is going to be about the best solution available to you.
