Too many years ago I bought my freezer from these people and boy did the interest icon

add up - 31.9% it says on my final statement. Can I really claim that amount or will it have to be the current contractual rate? Nothing like getting ahead of myself. I also paid approximately £125 insurance in case the freezer broke down within 5 years which I was supposed to get back. Needless to say they fobbed me off when that time arrived.

Thanks for the current address whoever is responsible, I would have sent it off to Rotherham.

You can try! I think the current contractual rate is probably more reasonable though. What is the currenvt rate - I just did a calc for Welcome and it was 36%!

That's just obscene!!!!! The current rate is what I was thinking so thanks for the confirmation. Still, if I get contractual that will be enough compensation as morally I would not be entitled to part of that given the time frame - but if I had known it were possible to claim it back earlier I would have done so.

I was going to file for non-compliance tomorrow but a letter arrived today which is really taking the mick. First off they inform me my request is called a Data Subject Access Report (oh really) and has a fee of £10. It then goes on to advise me that the fee was not enclosed with my original request. Do I still want the information and can I send them a cheque.

OH NO I WON'T SUNSHINE. Original cheque was cashed 31/01/08. Not my fault they are incompetant. Thought I would send this.

I am writing to inform you that I do still require a complete list of transactions and charges relating to my banking history with your organisation. I am concerned that you state you have not received the £10 fee as this was presented and honoured by my bank on 31/01/08. The bank was xxxx and the cheque number was xxxxx. I suggest you check with the relevant department within your organisation as I am not prepared to issue a further cheque.

Furthermore I had written to your organisation on xx March 2008 advising that failure to comply with my data Subject access request icon

within 7 days would result in my seeking a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice. Failure to respond positively to this letter by providing the information I require within the next 7 days will result in the action mentioned above.

It does say to send any correspondence to G E Money PO Box 700 Leeds LS99 2BD which is not the address I used for my other letters. Not my problem as far as I am concerned.

They failed to respond to my letter so I duly filed. I was then really surprised to get a letter from the court saying they intend to defend. Against what pray? If I have to lose a day's leave with the expense of going to court I will bring this to the judge's attention. Never filed for non-compliance before so this is an interesting development.

Well this is an irritating twist!!! Had a letter from their solicitors saying GE can't trace my original SAR icon

after an exhaustive search and can they have a copy plus a 2 week extension to locate info? Whatever for???? Not my concern they have to get their defence in for next weekend.

So I have politely declined that request but still put in copies of all 3 letters I had previously send 'as a gesture of goodwill icon

Their letter and mine crossed in the post as they wrote again last week asking for response to additional 14 days. Then today the data arrived with the offer to give me my £10 back in damages and any court fees if I will stop non-disclosure action.

I am feeling deeply suspicious of this as the letter was headed 'without prejudice icon

etc'. I am thinking of writing to the court with copies of all correspondance I lawfully can send keeping them informed of the machinations these clowns have been up to. Is it then down to the court to award me damages or not?

One of their interest icon

rates (which they charged me originally) is just under 32% so that will do when I claim my charges back. Shame it is under £50 after all this fuss.

Had a reply to my prelim offering me the magnificent sum of £12 as the difference between the charges and stating the OFT ruling deemed that a fee over £12.00 would be presumed to be an unreasonable charge for costs incurred as a result of breaching the terms and conditions of your credit agreement.

And there was me thinking the OFT could only make recommendations. So that's all right then is it................... I have been a bit sloppy though in that I did not take up their solicitor's offer of paying back my £10 SAR icon

fee and G E Money are now playing their face about it. I will now send lba icon

reminding them that their solicitor offered this £10 in compensation for my filing a non-compliance order and that the OFT can only make recommendations - courts make rulings.

I am perplexed at your assertion that the OFT ruled that £12 fee was reasonable on breaching the terms and conditions icon

of an agreement between the company and the individual concerned as it is my understanding that this figure was a recommendation only as rulings are the domain of the courts. Further as it had taken you over 4 months to comply with my request and I was obliged to apply for a non-compliance order to the court your solicitors offered to refund my £10 Data Subject access request icon

fee as compensation which I why I have included this in my schedule of charges.

Should I receive a cheque for £12.00 within the next 2 weeks I will accept it as part-payment only. I trust this makes my position clear.

I then used the lba from the library.

Will this do - any suggestions gratefully received.

Hi sally

I would suggest changing "this figure was a recommendation only as rulings are the domain of the courts." to "this figure is only for OFT's convenience - they will not take action for any figure below this - and OFT themselves say that only a court can decide what is fair."
