    Default Have you had a court summons from a PPC. Did the PPC show up?

    There seems to be an ongoing debate on this forum as to whether the PPC's actually show up at court when faced with a "properly prepared" defense.

    I think this question can be settled by inviting CAGicon members to share their experiences.

    So can you post up

    1. Have you had an invoice from a PPC [y/n]
    2. Did you refuse to pay it [y/n]
    3. Did they take you to court [y/n]
    4. What was the final outcome
    a) judgement for the PPC
    b) judgement for the defendant including counterclaim against PPC
    c) no show by the PPC (i.e. victory for defendant)
    d) withdrawl of proceedings by plaintiff
    e) a load of letters and then silence - no court dates

    Let's keep a running score and see how it goes. I'll count a yes to question 2 and option a to question 4 as a "victory for the PPC and the rest as "victory" against the PPC's.

    One thing I would ask is that you be prepared to provide proof of the above esp. if it went to court, judgement, transcripts, and court bundles.

    Should 4d not read withdrawal of proceedings by the PPC.

    The defendant cannot wothdraw proceedings that they did not initiate.

    Also, if taken to court by a PPC, I qould be counterclaiming for my time and expenses, so a no-show would be judgement in my favour - really a victory.

    This may be a way to counter an no-show by the PPC

    Good points Pat. I've corrected the original post. Apologies if my posts are a bit ropey I've not slept much in the past 2 days after having a tooth removed.

    4. e. Two letters from PPC. Three letters from "solicitors" Last one said fourteen days before Court action, that was April last year, nothing since.

    4 e) Three letters from UKPC - One from H.F.Co I even demanded they take me to court, no reply since 6th dec 2007.

    Excellent idea. I Will keep you posted. Mine is a bit early days yet (only been going since December.) My last letter (after two threats) was only about 2 weeks ago, asking for a court date. I will give it 28 days and post here.
    Maybe this should be made a sticky... If that's my understanding it's kinnda what everyone wants to know... results.. action and consequence...

    I am not paying them a penny until I have had my day in court at which point I anticipate the judge (their majesty) will buy me a beer afterwards having found in my favour, and apologise about the fact that decent people have to waste a day turning up to defend a totaly futile claim by a bunch of decidedly shady individuals. I actually want a day in court.... it's not like I'm not used to it!!!!!

    Remember, no other information other than that in the article has been presented to us, so no case numbers etc.

    Which means it could even be a setup by the PPC...

    Sorry Storm,

    Didn't mean to offend anyone, perhaps I did come across a bit strident.

    It is just that this was paraded as a great victory by the PPC brigade at the time. It took a deal of digging by Pepipoo members, complaints to the Press Association etc to get the paper to publish the actual truth of it. Predicably the retraction was much less prominent than the original story.
