    Default Bus Lane contravention?

    Does anyone know the correct wording for an accusation of being in a bus lane at the wrong time? I have a dead pcnicon from TfL stating ’ ...alleged contravention of being in a bus lane during hours of operation’. My friend has one from Camden that she is disputing on other grounds, but hers just says ‘being in a bus lane’. This might be easier to argue than her extended pitiful and excruciating pleas for mercy. Surely bus lanes exist all the time, but can only be contravened during specified hours (if they are signed adequately).

    A Bus lane is only a Bus lane during hours of operation. Outside of hours of restriction its not a Bus lane if it was you would not be allowed in it, if that makes sense. ie between 7-10 am the High street in my town is a bus lane (buses only) outside these hours its just a normal road.

    I think it depends on how the bus lane has been set up by the individual council. In Bristol they have several lanes that are in operation 24 hours. Ridiculous IMHO but people have received PCNs for using them.

    That was my point if its a Bus lane 24hrs then its a Bus Lane 24hrs, but if its only at set times outside those times its NOT a Bus lane its just a normal road.

    Yes, a normal road with the words BUS LANE writ large on it....
    So why was it defined on the pcnicon I got, and not my friend's?

    With a big sign telling you WHEN its a Bus Lane!

    What would you suggest the Council burn it off and re paint it every day??

    Most controlled zones have permit bays etc that are not 24/7 on the pcnicon it says 'parked in a permit bay without a permit', there is no mention of when prohibited because it is only a permit bay during hours of operation outside of that it has no meaning.

    Well part of her issue is that there was no sign to say what the hours were between where she turned into the road and the end of it. Now you might say, err on the side of caution, but there are other factors that I won't bore you with. I was just thinking it might be an easier route to challenge the terms of the contravention than the physical construction of a highway and junction that compels use of a bus lane. It could be worth bringing the difficulty to light as it may get the junction changed, but it's a long hard slog, as we well know. That's why people look for 'technicalities' to cut through the c**p. As did you with your 'green' 120mph.

    Missing signs are much easier way to get a pcnicon cancelled than trying to argue a point of law as Councils are much more likely to allow an appeal on that point, than agree to admit that every single PCN they issued in a Bus lane was non compliant (which they aren't).

    All the photos of signs they sent were of different parts of the road. That took some finding out by seeking out and relating them to the addresses of nearby shops shown in the photo. It's not a local location to her, and of course you can't park anywhere nearby to take your own photos
