    Default Barclaycard - Mercers Debt - V Scared !!

    Hi to everyone, this is my first time I have ever posted on a thread. I need some good solid advoce regarding Barclaycard.

    I owe Barclaycard £30k. (it's a very long story) I have had a set agreement repayment of £288.00 per month for about the last 2.5 years. Mid last year I wrote to them and informed them that I could no longer pay this amount. Every month I send them a cheque for around £50.00 with a letter stating that is all I can afford at present. I do not pay any interesticon on this amount.

    Every month I receve a letter stating that they do not accept this repayment, but they still bank the cheques. One of the last letters I had was that they are going to refer the debt to Mercers and issue a default notice. I know I owe them the money - I don't dispute this - I am scared witless.. At one stage last year I offered to settle the debt at around £7k or asked if we cold come to some sort of arrangement. The declined. This is the only debt (aprt from my mortgageicon) that I now have, I had even more debt that I have now managed to get rid off by coming to arrangement with the creditors. Just Barclaycard left. I am no longer in a position to offer part payment. Should I just carry on what I'm doing - or are there any loopholes anywhere that i could exploit. Am terrified of mercers starting to contact me as I work in local government.

    Any advive anyone could give me would be hugely appreciated.

    What kind of debt is it and when did you allegedly apply for it?

    It's credit card debt, that was ran up when I had a good paying job and a husband. I was stupid and naive, I didn't know how much was owed at the time. My husband abused my trust on a joint card. And by the time we had split up I was gobsmacked. As I said every other debt I was left with I have settled, I'm just left with this monster. I no longer have the card but was on a repayment planicon for ages. I cannot make the payments they are now requesting and as I said I pay what I can each month. I originally took out the Barclaycard credit card in around 1990 I think.

    If they are not willing to accept the £50 offer then tell them you are withdrawing any offers of repayment & that they are to cease all communication with you immediately.
    If they dont, make a complaint for harrassment.
    £50 is better to them than nothing at all & if i was in your shoes..id have told them to like it or lump it effectivley
    The usual jargon of..."we're taking you to court etc" will begin, but let it - most of the time, people never get taken to court anyway - but if it does come to that, as long as you can show the court that £50 is all you can afford to repay then Barclaycard can do sweet FA about it.
    Play awkward in situations like this & play the system to your advantage.
    You'll come out it all with the last laugh

    I would send Mercers a CCA if they do not supply this within a certain time limit 12 working days + 2 for posting, it places the debt in dispute at that point you can legaly stop paying.

    There is a template here

    Creditors and DCAs - Letter Templates & Budget Planner

    Scroll down to Letter N... enclose a cheque for £1... and send it by recorded delivery. Mercers have 12 working days (from receipt) to comply with your request.


    I had two b/card accounts from around this time they sent back fag packet type application forms for both.

    Haven't paid a penny since last May.

    Do not sign Print your signatureicon.

    Try not to worry, the advice you'll be given on here is excellent and there are plenty of lines of help.

    Personally, my first step would be what has already been offered as very good advice and send Mercers a CCA request letter. While the account is in disputeicon, they cannot take any further action.

    Hi Bismark44. First thing is dont be scared of Mercers they are Barclay's own insider debt collectorsicon so they are not independent. They Will try to bully you thats how they work. But give as good as you get. But whatever you do Dont let them try to talk you into a Consolidation Loan. That can be charged against your home a Credit card debt cannot. And my advice is do not deal with Mercers ignore them ( write and tell them ) and continue to deal with Barclay's. Now one interesting point is if you have been paying Barclay's £50.00 a month for several months and they have been accepting it. on a regular basis. they have accepted that amount as the payment by default. Write and tell them. also dont forget to mention it is all you can afford Dont let them bully you into filling in an income and expenditure form. You are the only one who knows your financial situation. Besides how much info has been lost recently. I dont trust anybody with any info of mine. It is no business of theirs . Best wishes to you and good hunting . Remember just get over the initial threat from Mercers and ignore any threats of a home visits its all bluff. As you do not accept home visits and you do not do business on the doorstep everything must be in writing and dont talk to them over the phone .. Cheers Dave

    Hi Bismark44. That is a great idea from Ananya. send for your CCA agreement and include a £1.00 postal order the have 12 working days to reply and while the account in in dispute they cannot proceed or add interesticon or other charges. Chin up we are all with you Cheers Dave

    Well done Barclaysicon

    Once again by being greedy and causing distressicon someone has looked for advice and found this site.

    If they can't supply an enforceable CCA (I doubt they can)

    Be prepared for long periods without contact from Mercers the incompetant ones.

    In both my cases they then pass the debt down the DCAicon food chain until it reaches Moorcroft. By then I knew they didn't have a leg to stand on.

    They can be a pain in the ass but if treated with the contempt they deserve will get the message and go away eventually.

    Should any of these ever contact you at work, immediately send a letter of complaint telling them to remove your phone numbers from their records if they phone again report them to the OFT.

    In all cases do not speak to them on the phone, refuse to answer security questions and simply state put it in writing, don't get into any conversations with them they will lie.

    I wouldn't worry about work finding out you would be suprised if you knew how many people are in the same position as yourself.
