Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have been with RBoS for 6 years I have had 'Maintenance' charges for the majority of the time that the account has been opened, but since December last year I have had about 6 charges (3 this month) of £35-£38 for returned DD and them paying a switch payment.
I went into my branch last week and queried the charges, their response was. 'You should make sure you have enough money in your account when your direct debits go out' and for the switch payment 'We have to pay switch payments and so we have a standard charge of £35 for doing this, please be more responsible when making switch payments in the future'
I found the woman to be very condisending, I am 21 years old not 16!! I am aware that I should not use my debit card if there isn't enough money in my account, but the switch payment mentioned above was to buy a train ticket for £3.30! How can they justify charging me £35, and if the transaction went through without me having enough money surely its THEIR fault for allowing it to be processed???
Also for the direct debits I currently have very little money going into my account so cannot afford to pay them at the moment, I actually contacted the company that were making the DD and they are now stopping them and allowing me to pay with a card at the PO. So not more returned DD charges!! I still want to claim back the ones that they have already charged me with though!
I have claimed back one charge back in December which was the very first one they applied, which was £38, and because they did this they say I can't reclaim anymore. Are they right??
I would be looking to claim approx £200, which would cover the overdraft that they have put me in! Is this enough and what are my chances of a settlement?
Thanks
