Have been in correspondence with Nationwide for the past couple of months, had my pack from the Data Protection Team (Sam Orams), and am not yet feeling brave enough to go to Court!!
However, am having one last go via the Financial Ombudsman and have completed a form (available online for printing off, although you can't send it electronically). Am I wasting my time here or is the Ombudsman service as impartial as it claims to be?
Someone say something to encourage me here. I want several hundreds of pounds back from Nationwide!!
I believe the Ombudsman has no power to act on these claims. They deal with complaints about the actions of the bank rather than a claim for return of your money taken unlawfully. We have taken the view that the claim is a separate matter but that once this is settled we will refer the way it was dealt with to the Ombudsman (this includes lost letters, failure to reply within deadline, very rude and agressive callers and many other breaches of the Banking Code).
It is your action and so your decision how to deal with it. You say you are nervous of court action but it will be the only way to get the money back. If you haven't already done so look at the templates and consider going back to the beginning to get the claim going. It is a big step to submitting the claim in court but the reality is that most banks will not pay up until you do so.
Beware Nationwide will close the account when settled, so get a parachute going.
