    Default need some good advise quickly

    Hi
    i am splitting with my husband after 20 years. He has an alcohol problem and unrelated health issues. This and bad decisions have now left us with a lot of debt. I am trying hard to hand on to my house. We have a secured loan - missed 2 months payment and he has an IVA. OMG what am i going to do. He is not really much help. i do have a good job but a mortgageicon and two kids etc it hard.
    spending my time in tears trying to cope day to day.

    Any help will be great.:cry:

    As i said he has an IVA which i dont think he will pay. We have a secured loan with Blackhorse and i have some small debts which are manageable.

    Problem with calling debt agencies as that i have started a new job. Work all week and have no privacy in the office.

    I really am panicking and with all the other stress i feel like i am struggling to cope.

    Just feels good telling someone. thanks

    National Debtline are open 9am to 9pm Mon to Fri & 9.30 - 1pm on a Saturday if this helps.

    If your ex's IVA fails either the IP who set it up or his creditors may go for bankruptcy ( depending on the exact circumstances ). There are some great advisers in this forum but I really think you need to discuss this properly with someone who can ask all of the relevant questions ( e.g is the property in joint names? How long has he been in the IVA? )

    its a new IVa only been going a few months and yes the property is in joint names though i know he would give that up. Can we do that do you know.

    yes i do think i need to talk to someone quickly just reluctant to do it but i will

    Will he be contributing to the mortgageicon still?

    Have you contacting HMRC to inform them of your change in circumstances, you might qualify for a high tax credits payment?

    he wont be contributing to anything or at least i dont think he will. I have contacted tax credits but i earn a decent wage so dont think i will get anything. youngest is 15 and eldest 19.


    Do you know if i can get him taken off the mortgageicon at all?

    after spending 18mth in court with my husband im sure you wont be able to take him off the mortgageicon unless
    he decides thats what he wants

    ok thanks i will get on to tax credits then and i will make some calls in the morning. i was thinking about the secured loan. Maybe i could call them and try to make reduced payments.?? all getting on top of me at the minute. best to call someone i guess.

    we have a secured loan with Blackgorse and he has an IVA. He wont pay any of them and i have paided last months but as they total £600 a month there is no way i can continue. losing sleep over this.very worried.

    Rite and other than the mortage these are the only debts?

    Dont pay the IVA if it is in only his name.

    The IVA is it covering any of your debts?

    You may want to see if all the paperwork is in order for the secured loan. How much is the loan for?

    The IVA is due to be paid on tuesday and i am seriously thinking of putting the £300 in the bank to cover the debit though i cant afford it and we prob wont eat much for a while. The IVA covered his loan and credit card and had nothing to do with me but i am so worried about my house and losing it.

    The loan - secured- is with Blackhorse and was for 15K this is in joint names. Not sure what you mean about the paperwork being in order though. Can you explain please

    DONT PAY THE IVA.

    I am assuming you still have all paperwork in the house.

    What l mean is do they have a valid cca?

    What payments have been made? how much is it in arrers if any?

    if you have non of this you could always ask the bank for the information buy going down to the bank and asking for copys of it. You may need to explain that you have split from your partner and he has taken the paperwork so you can see what your obligations are.

    thank you for you swift response. Im confused...when you mentioned the paperwork did you mean the iva stuff or blackhorse loan. yes i do have paperwork here somewere. and yes he has missed 1 iva payment already and 2 loan payments but i was planning to call blackhorse tomorrow and make a payment.

    rite well if you are calling to make payment l would ask what the obligation is due to the split. Does the debt get split in half and you are only responsible for half or summing.

    maybe you could also agree a lower re payments.
