    Default A&L Charges

    Hi everybody,
    Just got back from a New Year break at my sons house and said I would get some advice for a problem he has with A&L.

    He has a current account with them with NO overdrafticon facility.
    In November 07 he made two £10 withdrawls thinking he had £26.00 in the account.

    When he got his December 07 statement yesterday, he found that he had gone overdrawn by £14 as he had mis-calculated and only had £6.00 in his account at the time of making the withdrawls.

    But as the cash machine gave him the money he assumed the funds were there, as he does not have an overdraft facility on the account.

    Now they have charged him for £55 (11days at £5 perday) plus £25.00 for each £10 withdrawl making £105 for being £14.00 overdrawn for 11 days.

    Now this fortnights incapacity benefit payment has virtually gone on these charges.

    How do they get away with charging these extortionate amounts, I thought the OFT had ruled these unlawful?

    Are they allowed to let an account with no overdraft facility to go overdrawn just to rake in these fees?

    I told him to make a formal complaint but he is not good with writting these kinds of letters, so said I would get some help for him.

    Does anyone have any advice or a good template he could sent to try and get these fees reduced or refunded? He has next to nothing to live on now for the next two weeks.

    I have recently had a similar experience and would appreciate any help or advice as well. I've posted about it here:

    In my situation I was about £120 overdrawn for 12 hours and was charged £55. This can't be legal can it? I might start putting my money under my mattress at this rate. It might be a lot safer there!
