    Default Barclaycard Credit Card

    Hey I hope this is the place to write this but I need some help urgently. I have been "with" Barclaycard for about 7 years now and despite the account being not in use I still owe around £1000 on it. The thing is that I used the account when I was in University and the Credit limit is (and always has been) £350. I have paid in total around £1000 easily on the account in payments and although they have revoked the card (about 3 years ago) they continually still charged me full whack for everything and I have an agreed £35 monthly repayment planicon.

    I have easily paid the balance in full that was owed a few years ago but because of charge after charge, the balance keeps growing and growing and i don't even use the card. Barclaycard say that there is nothing I can do despite the numerous phone callsicon I have made over the years.

    Please HELP! Thanks in advance for all assistance.

    I have (nearly) all my statements and all slips that shows all payments I have made over the years. This is and has been stressing me out for years!

    Hi Zxx and welcome to the Barclaycard forum.

    This certainly is the right place for you to post your thread.

    You need to read the "Reclaim Charges Guide" - click on the link just below my name. This will give you a good idea of how to proceed. If you have nearly all your statements, list all the charges (I'd add up all 7 years worth) on the site Spreadsheet and see what the total is.

    Come back with any queries after reading the guide. You should be ready then to send off your Prelim Claim letter.

    Just to add, they may well dispute the earliest charges (any over 6 yearsicon) but they may pay them anyway. Try it and see.

    Can I suggest you go for 6 yearsicon (which starts January 2002 if you write your first letter this month) and then go for older charges once you have more experience. Send off your SARicon for those missing statements and use the time while you are waiting for them to arrive to do lots of reading on the forums. Things are going to look up this year, honest.

    Hi ZXX and Sally,

    Just to explain my reasoning:-

    **If all the chgs are claimed for, the early ones can be left off any settlement if that is what is negotiated with BC before Court proceedings are started.

    **If you file proceedings and negotiate before court, you are in a good position to try and get ALL the chgs repaid, again by negotiation before a Court Hearing date. BC will not want to take the claim into court.

    **If you reclaim your latest 6 years' chgs, you will get them back. However, you will then have to start Court Proceedings to reclaim the earlier chgs.

    **THE WHOLE of that claim will rely on you claiming outside the statute of limitationsicon and you are on far weaker ground here in legal terms. BC will almost certainly challenge this in Court.

    My theory is to claim the 7 years and drop the early chgs from settlement if you have to. If you don't claim the early chgs now, you definately won't get them on a later and seperate claim.
