Recived today from Monument a letter regarding the transfer of the account to Raphael & Sons,
For your records you will find enclosed a copy of your Monument card agreement and the terms and conditions as currently applied to your account.
Please note that the terms and conditions of your Monument card account have not changed.
On the back of this letter it states this is a Credit Card Agreement regulated by the Consumer Credit Act 1974, between Raphael & sons and by myself with my address. On a seperate page are the terms and conditions.
I do have a debt with Monument but have an arrangement to pay so much a month so have had no problems with them.
Has anyone else had a new agreement sent to them? And if I wanted to CCA them, would they still have to produce the original with my sig on it to make it legal.
Is this a new way forward for credit card companies to send out new agreements with no one signing them.
Any thoughts.

I understand that Barclays has transferred all its rights under your Monument Card agreement to R Raphael & Sons plc. R Raphael & Sons plc is a bank. Others have rec'd the same letter as you.
You should receive a new card if the a/c is still active, although from what you say, you may just be clearing the debt on a monthly basis.
Have you reclaimed any chgs on the a/c. Is interest still being charged on the a/c.
If you decide to send a CCA request, it will go to the new company as they have now taken over Monument's business.
Carry on paying the monthly amount in the meantime.

No the account is not active, I owe about £4.000 and I pay £60 amonth to pay off the debt, interest is not added at the moment,
There are charges on this account but have been dealing with more urgent DCA's. I havent sent a CCA request yet but as they have sent a new Credit Agreement it would be interesting to see what was provided as the original.
The account is reviewd every 3 months by Monument so will be interesting to see if the new company will let the payments run or request all the money to be paid.
If R & Sons are happy to continue to accept the £60 per month and you are able to pay it, then continue until it's next reviewed.
If R & Sons decide to be more harsh about the debt, and try to up the pay'ts beyond your means, or place the whole debt for coll'n with a DCA, then would be the time to see if they have the nec'y paperwork to conform with a CCA request.
