Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I'm hoping someone can help me. I've had a look at the templates in the stickies for reclaiming PPI but I'm a bit stuck!!
I was offered a CC about 4 years ago by my bank which I accepted so that I could switch balances. I told the salesperson (do we call them anything else!?!) that due to disability I haven't worked since Dec 1999 & my only income was LTIB & DLA which he said wasn't a problem. I thought I'd signed to say no to PPI because of this but it seems I only signed the form as since then I've been paying PPI each month. I have asked the bank on several occasions to cancel it & have also written to them (I forgot to send RD & it appears to never have been recieved!) & still I'm paying PPI each month!!
A friend has now told me about reclaiming & I'm keen to do this as well as get it stopped as at the moment about 75-80% of my monthly payment is going on interest & PPI!!
In the templates it talks about having the name of the person, I don't have this but know that he hasn't worked at the bank for a long time due to a string of complaints (he almost stitched my ex up on something similar) so how would I get this info? Also, how can I find out exactly how much I've paid in PPI & therefore need to reclaim? Can I get all of this info from the bank?
Sorry I'm not really sure about what you mean by "in the templates it talks about having the name of the person". If you mean the name of the lender then this is simply the name of the financial organisation not an individual's name. Have a read here http://www.consumeractiongroup.co.uk...claimants.html if you haven't already. Your policy was clearly missold if you were not working when the policy was taken out.
Thanks for replying In the first letter template it mentions "The name of the salesperson who sold me the policy is ..." which is maybe where I've got confused?
Can you help with my other questions at all please?

Yes, you just need to send the bank a S.A.R - (Subject access request) http://www.consumeractiongroup.co.uk...s-request.html There is a maximum of a £10 fee for this and the SAR should be sent to the companies registered address. If you don't know the companies registered address then if you post the name of the company we will be able to give you it.
Just had a thought, I think there may have been a time where I was late with some payments & as such got stung with large charges, will they show on the SAR & if so can I claim them back at the same time, ie, within the same claim or will I just be complicating things for myself?

Yes.

You can claim them back on the same claim but I would keep them seperate as due to the OFT test case on bank charges some credit card charges cases are also being stayed. If your PPI claim were to go to court and it was just for PPI then it definitely won't be stayed but if it also contains credit card charges there is a small chance that it might be.
