I am in the process of calculating the charges on my wife's Platinum Card that started out initially as a Monument Card. I have 2 questions. First: can I calculate the charges on the one claim or should I do two? Second : do I claim the charges up to July 2006 when they reduced to £12.00 per item or do I claim them up to date?
Hi, claim it all, the £12 is just a guidance and anything above then the OFT would want to take a look, BUT the companies still have to prove that this is a true reflection of costs incurred.
secondly, if the card was taken over by another card and reissued, then claim for both cards, as long as they are now managed by the same company, I hope that this makes sense, it is late

Also, be aware that they may try to offer to refund you JUST the excess above the £12 set as a limit by the OFT.
Ignore this as the charges are still being repaid IN FULL by the CC companies. They are unlawful penalty charges and they will repay them. So claim the FULL charges paid to date.
Good luck with your claim and come back anytime with any queries.

Hi, I have been looking at the POC-N1 and have a question. At point 19. it states 'The Defendant has not repaid them or any of them.' In my case they have made an initial refund of the difference between actual charges and £12.00. How should I alter point 19? and do I now have to redo my schedule to alter the earlier charges to £12.00?

Thanks for the reply, I did reject the offer and told them I would accept it as partial settlement giving them 14 days for full payment. I will do as you advise and ignore it in my POC
Just realised this should be in BC forum - I'll get it moved and merged with your earlier thread. Please stick to the same thread so your case is kept together.
