    Default Mortgage arrears

    My situation is different. Due to financial difficulties my mortgageicon has about a year's worth of arrears. I am actually selling my home before it's repossessed. The mortgageicon company (which is not a high street bank) have charged £65 for every month payment was not made in full plus several £100 for sending out a "debt advisor" to visit me. Naturally I agree to pay back the mortgage and arrears but do I have to pay all the added charges? Thank you.

    Was the £65 for a service that they provided or was it a penalty for paying late? Did they manually do anything to justify the charge? If not then it seems to me that it is unlawful.

    I guess the debt advisor could have been a service, but did you have a choice in this? You could have got debt advise for free from a debt advisory service. What service did they provide for the £100?

    Most people here are claiming back charges, but you are talking about not paying them in the first place, which is a different matter. You could consider paying them if you have to and then claiming them back later, but this is just a suggestion.

    When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.
