I have received a letter from Lowell Portfolio 1 saying they have purchased in deember this year an account from Barclaycard. They are appointing Red and I should contact them by phone.
Now not my first dealings with them even had the 'Hamptons' letters as well for a Capital One Card.
They have the address wrong they have flat number although majority of address is correct and I have not had a Barclaycard since approx 1992, I've moved home 3 times since then, I'm not aware of any outstanding problems with Barclaycard since my card was taken and destroyed by Barclay's bank.
What should I do? do I write to them or ignore them?
Previously for Capital One I requested a statement, copy of cca , received statement although after the period , never seen a cca. I told them they had defaulted against the consumer act, they acknowledged my complaint back in September but since heard nothing from them regarding Capital One. I complained they were writing to the wrong address despite telling them my correct address previously, guess what they still wrote to old address. Contacted consumer direct who advised pay nothing they have to prove they own debt and have complied, I have a set of forms from the Office of Fair Trading who want to investigate that case.
Is this letter a fishing exercise to get my correct address?
Lowells Hamptons and Red are one and the same. They use different notepaper but the threats are usually the same. Re your cap one Debt, Lowells bought a shed load of these and they are practically unenforceable as they are application forms without the prescribed terms. Lowells know this but will still try to bluff you into paying.
If you have not had a Barclaycard since 1992 then any debt from it would be well and truly statute barred. Again Lowells a well known for the purchase of Statute Barred Debt which is totally unenforcable. You can ignore their empty threats or you can send them a Statute Barred Feck Off letter. If they continue to chase a Statute Barred Debt and threat all sorts of Legal Action then I would suggest a formal complaint about them to Leeds Trading Standards who are well aware of the activities of these people
well i sent off a letter, now i've got a reply from red
we are disappointed that the monies you have previously had the benefit of are still outstanding and you have not taken responsibility to clear the outstanding debt.
your account is now to be passed to our specialist recoveries unit who will ultimately decide the best form of action that is to be taken in order to recover the outstading amount.
to avoid this going any further you must call us and arrange repayment. we WILL have a repayment plan that is affordable to you and that will fit within your current financial budget

now it seems they've either read my letter , accepted they can't enforce through courts but they've ignored the OFT section.
so they also havn't proved its my debt or even my barclaycard, seems strange that barclaycard would have file on debt that expired nearly 10 years ago. Bear in mind Barclaycard wouldn't of had my current address.

Thank you for you recent pointless letter. I note that you have passed this alleged debt to your 'Specialist Recoveries Unit'' to decide the best form of action they can take to recover the oustanding amount.
For the avoidance of ANY doubt. The Alleged debt IS statute barred. I will not be paying any money towards it. There is Feck All you can do about it. You have now breached the OFT guidelines with regard to collection of Statute Barred Debt by intimating that there is something you can actually do.. Please send me details of your complaints procedure by return. I have also passed this matter on to TS and the OFT.
