Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I recently sent a full SAR with £10 to a company to ask them for all the information they hold on me and my account. I specified that I want everything they have including calls or transcripts of calls etc.
I said they had 40 days to respond and they wrote back to me asking me to fill in a form. In the covering letter they tell me they have 40 days to respond from the time they get the form back and receive identification to prove I am entitled to the information not from the time of my request.
The form requires lots of information including - My Date of birth, previous addresses etc.
The form also says that I must provide dates and times of calls if I want details of them or anything relating to them!
I dont know how to deal with this because I need call logs at least and I know they have them.
Please could someone tell me -
What exactly do I have to tell them about my personal details to get the information? Am I entitled to all the call information on their systems without giving them dates and times? and what of their extended 40 days to provide the information?
I take it they have written to you before now so they obviously know your details and address etc or they wouldnt have written to you. This seems to be a stalling tactic by them, assuming your S.A.R - (Subject access request) was from the templates on here then I would be inclined to write back to them advising them that the clock is ticking and YOUR time scale is relevant not theirs. As for their form, it is irrelevant, they MUST, on receiving a SAR, furnish you with copies of EVERYTHING they have on your account, including phone recordings etc, not specific dates but ALL.
Make sure any corres you send is sent recorded and keep copies for your own evidence should you need it at a later date.
Hope this helps, if I have missed anything out I'm sure someone will advise accordingly
