Wonder if any one can help put my mind at rest,

 

Hubby had a accident this week, the other driver admitted fault straight away, and also a independent witness said it was not hubbys fault, we rang our insurance and told them what had happened and that it was not hubbys fault, they sent soemone out to collect the car, but did not leave a courtesy car as they said they had to assess the damage first, they also said hubby has to pay the £350 excess when the car is returned.

 

The garage rang this morning to say it looks as though the car is a total loss but thy will have to get a churchill engineer to look at the car and assess the damage.

 

The car is a P reg Vauxhall Corsa, if they say its a total loss they will deduct the excess of £350 from the settlement. seems the accident was not hubbys fault can we not demand they dont deduct the excess?

 

We have already given them the other drivers name and address and which insurance company he is with along with the name and contact number of the witness.

 

How do we know if they are offering us a fair market value price for the car?

Wobbles,

 

An excess in an uninsured loss. The part of your insurance policy which is not covered. It is eithrt voluntary ot compulsory depending upon age/experience etc. If vehicle therefore deemed a t/loss then this will be deducted from settlement. Similarly if repairable, you would have to pay the excess to the garage to get the vehicle back.

 

This however is recoverable from the other party's insurance. If you have legal services, they will do this on your behalf. If not, write to the other insurer enclosing copy of receipt along with any other "uninsured" losses.

I will just have to wait and see what is happening now, probably wont hear anything till after christmas.

I've recently had an accident that was not my fault and I am insured with Churchill - my car assessed as a total loss. Did you not take out CLAS - Churchill Legal Expenses - if so get them to instruct a solicitor to act on your behalf. I am also arguing my total loss offer as I feel it is a little low. Churchill will look at the GLASS's guide to determine what offer is reasonable but I suggest you look locally in the autotrader as well to see what it would cost to replace your car taking into account the same make/model mileage condition etc.

thanks for the reply mooreda. Looking at the Schedule of Insrance it says, Sections A; B; C; D; E; F; G; Ji in your policy booklet are the sections that apply, the CLAS is section H, so not sure if he has it or not, but on the back of the schedule it says: Cover limits Churchill Legal Assistance Service Limit (section H) £100,000.

quick update, churchill rang hubby yesterday and offered him £620 for the car he said he wasnt happy with that so they siad £700, he said yes that seems fair.

 

they are sending out froms and we have to send Vechile Registration Documnet to them then they will send him a cheque for the full £700 so it looks like they are not deducting the excess after all.
