The FSA do have the power to take court action against regulated companies that do not abide by their adjudications, or breach the FSA principles for business.

Regarding your first point, there is a difficulty in that the fosicon are log-jammed with claims and are many months behind with cases. If you look through the threads on this forum you will find some cases where claims have been met - however, you will also find many others where the bank has challenged the initial ruling and cases are in the queue waiting for full adjudication.

The other thing that you have to remember is that the FOS can usually only deal with claims that relate to agreements made after January 2005. There are cases where they will look at earlier agreements, but usually these have to go through the court route.
