We started a little battle with Blackhorse a few months back to claim back PPI which was mis sold in Aug 2004.
Basically, we were told that unless we took out PPI along side the loan, the application would be unsucessful. Also, I explained that my husband had a level of cover through work, and was told yet again that the application would be unsuccessful unless the cover was taken out along side the loan. We were never given loan repayment figures, which did not include the PPI, dispite asking for a Breakdown.
We sent the first letter (using template), were sent a reply stating that the PPI was not mis sold, as we had signed the agreements and also, had answered the questionaire.
Then sent another letter, stating we were not happy, gave them a further 14 days to reply before the matter be passed to the fos.
Have just received another letter, stating that they are sticking with their decision, as we can not give any documentation to back up our complaint.
Called the FOS this morning, have been told that they can not look into our complaint as in 2004 Blackhorse were not regulated. They were regulated in 2005.
So.....now what do we do??? Is this the end of the road?!!!!
Have worked out we have paid over 6K for the PPI SO FAR. Makes me sick that we were forced to agree to something so expensive.
Have a look through the information in the stickies - you can go through the county court route. If the policy was missold you would be claiming under the Misrepresentation Act, effectively that switches the burden of proof on them to show they did not make a misrepresentation, so lack of documents is their problem, not yours.
In the meantime I would do a for DSAR - again, details are in the stickies.
