    Default First Plus - advice needed!

    I am battling First Plus on mis-selling due to the fact that both hubby and I had good sickness/redundancyicon/life cover through our Local Government employers. Their 1st letter basically said 'no chance' so I applied for a SARicon for a copy of all call recordings. They have now sent me 'all available recordings' but the inital call where PPIicon was dicussed is not on the tape. So I now think they are either keeping the call from me or do not have it all!! No really sure what to do now so any advice would be much appreciated thanks.

    Me too - waiting for response to SARicon from first plus on behalf of my friend. Cheque was cashed about three weeks ago.

    If the policy was unsuitable for your needs, you are claiming that they made a misrepresentation to you at the time of the sale (by suggesting it was) - that switches the burden of proof onto them. Therefore, the fact that such a vital call is "missing" from the tape would not help their case.

    Thanks for that! This has been the only loan we ever had PPIicon on because I felt I couldn't say no, even though I told the 'sales person' that we had cover through our employers. I'm not sure now whether I need to write back to First Plus or just go straight to Ombudsmanicon???

    As they have sent a letter saying they will not refund, then you can go straight to the fosicon. If you decide to go the court route you would really need to send a letter before actionicon.

    Their letter didn't state 'final response' so don't know which route is best, court or fosicon? If I go FOS route then looking at other peoples posts I can just fill a complaint form and put a ? in the 'have you had their final response' box.

    Can I be really cheeky and ask which route would you suggest???

    If you have not had a final response then you will have to write again - they then have 8 weeks in which to "investigate" your complaint.

    If you leave it blank on the form they will pass the complaint on to the company - and give them 8 weeks to respond. Of course that will be when they have looked at the complaint - so you will have an even longer delay.

    The court route is faster - however, you have to be aware that the matter could go to court, and you would have to feel confident that you can argue your case in front of a District Judge.

    Unfortunately, I cannot advise you on which route to take.
