To date:
My flatmate (for it is actually his card) decided to pay the last bill (but withdrew money from the card in question to do it , unbeknown to me) on the basis that the advisor told him (well, me), that they did have a copy and it had been posted.
To date, we have yet to receive the requested CCA copy, but they have sent another statement, received today. I have responded with a nice leter quoting the Act and relevant regulations as to time etc. telling them they won't get a sausage until they give me a copy of the agreement (signed), and that I will report them if they don't provide it by the time 30 days are up.
I am pretty sure they will ignore the letter completely and send a default letter / add charges etc. I shall however keep ou updated in the hope it may be of some use to others.
Re: Lloyds TSB CCA Request - lets see what happens!
Have had a response - a photcopy of a document entitled "Your upgrade credit card application and agreement" which is duly signed by flatmate.
3 years ago he was called by Lloyds asking if he wanted to set up a new card and transfer the balance from the old card and cancel that card - which he did do.
does this count as a new agreement or a variation to the original agreement? And where do I go from here? It is dated before the new agreement regs so they dont apply.
