Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have today received a 'one time only' offer from Bank of Scotland to reduce my debt by 40% if I pay a lump sum today (I would have had 7 days to find the money if they'd used a 1st class stamp).
They defaulted on the CCA request in July.
They have written using a name that I stopped using 2 years ago.
The balance quoted is 90% charges (credit card).
If I haven't paid by today they are threatening to sell to a DCA.
Now, I'm a bit busy with 4 other accounts at the moment so I really can't be bothered to issue reminders on this one at the moment. So far as I can see my options are:-
1. Ignore. Let them do their worst. When the DCA contacts me express surprise that they should have been passed an account in dispute and tell them, politely, to go away.
2. Drop a ton of bricks on BOS for trying to collect on an account in dispute then sit back and wait for them to send the CCA, which I know they do not have as I didn't sign one.
If it wasn't just coming up to Christmas and I didn't have better things to do, option 2 might be tempting but I'm having enough trouble keeping track of the four other accounts without adding another complaint to the pile so they may get away with it this time. It goes against all my principles to let them get away with anything though, so if there's nothing good on TV tonight ....
I would be interested to hear if anyone else has received a 'truly marvellous' offer like this recently. I wonder if they're trying to ditch all the stuff they don't have a hope of collecting?
I am not an expert in law, finance or any related field, I just read a lot. Any advice is based solely on what I've read so please don't take it as gospel without checking it out yourself.
I prefer not to give advice by PM. If you want me to look at something, send me a link to your thread, and if I can help I'll reply on there.
