Hopefully someone can advice me.......

 

Today I recieved a telephone call from my car Insurers asking me did I know I was involved in an accident ? No time or place known at that time by the insurers. I said I have never been involved in any accidents.

 

The operative said she would ring the other company for more information ie: date of accident, details of the car reg/colour/make etc...

 

She came back with 'yes it is your car and it was being driven by Mr So & So who proclaimed he was your nephew'. I told her I had no knowledge of this person nor did I have a nephew of that name.

 

After checking dates I realised that on the date of the accident my car was at a brother of my daughters friends house having some work done on it (engine management light and door lock). I took the car there and collected it.

 

Well it appears that he must have been the driver and gave false information (not sure why).

 

I only have a Christian name for him and a mobile number which I have passed onto the Insurers and will be sourcing his address later today to pass on as well.

 

What I would like to know is were this leaves me ?? I had no idea this young man was driving my car and never gave permission to. Am I liable ??

 

At present my car is in a garage having repairs done as someone unknown hit it outside my house last week. I shall already lose my no claims bonus and have to pay the exemption fee of £250.

I am not an expert on this, but I would say unfortunately you are liable, even though you did not give the driver permission to drive, you gave the person the keys to the vehicle. As he was repairing the vehicle, the Insurers will probably feel that this included a "test drive", to ensure that the vehicle is working correctly. You really need to find out this persons address, and inform the insurance company of this - he might have a DOC [driving other cars] extension on his policy.

Many thanx Craig for responding.

I guess youre right but he had no need to drive my car, it was the engine management light and the door lock that were being repaired, he just needed to switch the engine on.

I have passed his address on to the Insurers today.
