Can anyone advise as to what my son can do with regards to PPI payment made on his credit card. The story is a bit long winded so please bare with me.
He has had a credit card with Capital One since 2002 and always paid on time. Then just over 12 months ago his received a
phone call
from Capital One saying he should take out a PPI on his account as it would cover his monthly repayments should he fall ill or be unemployed.
He thought this plan was a good idea and agreed to the PPI payments to be added to his account balance each month at a % of the outstanding balance. Then unfortunately in February this year he suffered a nervious
Breakdown
so was unable to work until three weeks ago when he returned to work.
As he was only on sickness benefit he could not afford the monthy repayments on his card, so he contacted Capital One to make a claim under the PPI. He was told the necessary forms would be sent to him. One month later another statement arrived but no forms. So he contacted them again, "we are sorry, we will get them in the post to you today" Another month and another statement still no forms. He called them again, "they will be in the post to you right away".
And guess what a month later another statement but no forms. He rang them again, forth time now. This time he was told the PPI plan had been cancelled because he had missed three payments on the account. He explained to them that he was still waiting for the forms to make the claim. You are to late to make a claim now and they want the full balance paid immediately. He told them this was impossible due to being ill and that was why he was trying to make a claim on the PPI.
To cut this a bit shorter, after a few heated words with the clowns at Capital One he was basically told the PPI plan was now cancelled because he had missed three payments and if the full balance was not paid immediately a default would be issued and the account sold to a
DCA
.
Now what I need to know is how does he go about claiming all the PPI payment he has paid on this account, as this insurance was in my opinion just a con. They mess you about with the forms to make a claim for long enough that the policy is void, very clever [problem]. No need to pay out then.
I am on to Capital One for him with regards to a CCA, but that is on another post.
All I rearly need on this topic is some advice or assistance on how to go about claiming these PPI payments back for him as they must have broken some rules regarding their behaviour, so all the payments he made were for nothing, they never upheld their side of the agreement to cover payments for the very situations they were sold as covering.
