Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I had an outstanding council tax bill which was passed to Equita,we received one letter on Friday,i rang the company it had already been passed to the bailiffs, they gave me his number,i rang straight away to be told he was off work and to ring on monday which i did in the meantime we got a further two letters from Equita,i rang again on monday he still could not speak to me so ring tuesday! which my husband did,he was told in no uncertain terms that it was past a repayment plan they want all the money,i rang again at teatime and the bill had increased by £200!!!! i dont know why it had increased in less than twleve hours because the amount outstanding was the same when he spoke to my husband. My husband is going to attempt to speak to the council tomorrow we can just about manage to pay half the amount before xmas,I have informed the bailiff of our intentions to pay upto half he has said he will accept payment but the action will continue.Since reading various posts on this fab website i have learnt that i should pay the council direct and not the bailiff as he will take out his share first.
I am sure Tomtubby will be along to help you soon, but for now be sure not to let the bailiff into your home if you haven't already done this.
The extra £200 sounds very wrong.....
Good luck speaking to the council, they may accept a reasonable offer directly if you are prepared to pay the first instalment immediately. Inform the council that you are wary of the bailiff company in light of the extra charges which are inaccurate and that you are not prepared to deal with them.
Spoke to council this morning, they say that the account has been with equita since October, the £200 fee added on will be fully justified because they are certified bailiffs!! they then advised me to speak to equita direct about bill.
When i informed her that equita dont listen and just direct you to the bailiff she said that 'they are instructed to do so!'
SO WHAT IS THE POINT IN PHONING THEM DIRECT!!!!!
I informed the woman from the council that we will pay part of the amount on Friday straight to the council and half in December, she said that they will take the amount from us but the bailiff will still continue action to recover his costs, thus adding extra costs to the bill!!
