    Exclamation Mercers and Barclaycard

    Hi

    I have a problem with my Barclaycard and i'm being called at least 5 times per day but "Mercers". I've taken to not answering my telephone but I don't know what the procedure is to pay my debt off. I have an outstanding balance of £3,000 but i'm £300 approx behind in my payments. I'm currently having difficulty in paying some of my creditors and I don't have £300 spare at the moment so does anyone know if I am able to offer a certain fixed amount until my arrears are paid?

    First NEVER talk to these "people" on the phone as they will try and get you to agree to anything.

    Before you even think about making any sort of acknowledgement or payment to a DCAicon you MUST ensure that they have the LEGAL right to collect the debt.
    This is achieved by requesting a copy of the Signed, Executed Credit Agreement via a Consumer Credit Act (CCA) request.

    Is it important to start the letter:
    I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY in Big Bold letters.

    It is best to send this request via recorded/special delivery as there are some important deadlines to observe.

    After 12 WORKING days the "debt" is in default and stays that way until the request is complied with.
    If a FURTHER month passes then the DCA has committed a summary criminal offence and the matter should be referred to Trading Standards for action once the DCA continues to demand payment.

    I hope this clarifies some things.

    Any charges on your Barclaycard account? You should be claiming those back too. Could make quite a dent in your debt if you've had problems paying!

    DLC: Given up, gone away.
    Eversheds: Trying!
    Equidebt: In default
    Intrum J: Return to OC
    iQor: Stopped paying.

    ScotCall: Return to OC
    Thames: Stopped paying.

    The advice you have been given so far is great and I would follow it to the letter.

    I would just like to add this link, as you seem to be having a rough time with them calling you http://www.consumeractiongroup.co.uk...tion-plan.html

    If you just want them to stop outright, you can get BT to block witheld numbers or use the choose to refuse service. you may even want to answer the phone to simply say 'I ask for you to place all communication in writing' and hang up. I don't advocate calling them but this might be a good scenario to have to hand if they ever catch you on the hop and you answer the phone.

    i would report this to trading standards, via consumer direct. It's not on.

    have you considered BT Chose to refuse? and sending the telephone harassment letter?
