Advice needed please re. water company court claim forms
Both my other half and I have received county court claim forms from our water company.
Earlier on this year, when we had very severe financial difficulties, I contacted the water company to try to arrange to repay our arrears, and offered to set up a direct debit of 30.00 per month. The person I spoke to refused this, and said that I must pay 60.00. Obviously I said that I couldn't do this, therefore she advised my to contact them again when I COULD afford this amount, and then they would set up a direct debit.
So, it's come to court action now. It's only for a few hundred pounds, and in a couple of weeks, I am hoping that I will have the funds available to pay this off in full, though I would begrudge paying the additional 100.00 that they have added on for the court fee, solicitors costs and interest.
Could anyone advise what to do next? I am thinking of filing the aos, which will give me another 2 weeks, then hopefully paying off the amount I agree I owe, and disputing the additional fees. I'm not bothered about getting another CCJ - it's just another one to add to my portfolio
Is it right that they've sent both me and my other half court forms? I guess so as both our names are on the bill.......
Oh, and another thing, they've spelt our surname wrong (always have on all correspondance) - does that matter at all?

By filing the Acknowledgement of Service will give you 28 days from the original 'Deemed Date of Service' to file a defence

No, although if you dispute this, they will have to re-serve corrected papers, but I'm not sure whether the clock starts over again or not, ie giving you more time. Try phoning the court and ask.

Can anyone help me with my defence for this one please?
Another thing is, they are claiming for water charges up until 31th March 2008 - we moved from that address last week, so surely the claim must now be 'incorrect'?

I didn't manage to get a defence in on time for this one, and the ccj papers arrived this morning.
I have a couple more questions -
1. If I pay off the amount owing in full within one month, how much is the fee to cancel the entry on the register?
2. The amount of the judgment is 369.59 for the debt (and interest to date of judgment) plus 102.00 for costs, whereas on the claim form I received, the amount for court fee and costs was 80.00 - where has this extra 22.00 appeared from?
