Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Both SLC and HSL are chasing me for "Arrears" due to me not getting them my deferral forms. I was living in Taiwan at the time and moved around a lot. Fair enough. Now I'm in the Philippines and my income is very low indeed (rent is 70 quid a month...) and they are still after the arrears despite me filling in the financial forms and getting in immediate contact when one bright spark had the revolutionary idea of emailing me. So I CCA'd them and SAR'd both of them. And then the fun began.
Honours student loans sent me all 4 agreements - even though they are only holding three of my loans. One of their loan agreements was unsigned. They also sent me a "Termination" notice in one of their requests for money. I reported them to Consumer Direct for trying to collect on an unsigned agreement and have just had a letter today saying that they'll accept the 5 pound per month which I agreed with a Call Centre guy 6 months ago and have been paying each month.
Now onto the SLC..I was waiting with interest for my CCA off them given that HSL's copy was unsigned. I also got it today (2 months after they received my request) and it WAS SIGNED. So, I did a bit of checking. I signed it om the 27th of August (Friday) 1999. They signed and dated it 30th of August 1999 (Monday). The 30th of August 1999 was a bank-holiday so even if they were working the post would have been undelivered and I feel that it would have been impossible for it to have been delivered and processed.
I am going to report them to CD again. I can't contact my local trading standards as I am non-resident.
My question is what to do with the blatant backdating of the signature?
