I have an open dispute with fos regarding mis-sold PPI which is currently with a case worker, and has been since late August this year.
Among the many things that annoy me about HFC is their Cowboy'esk nature. I phoned my local branch to complain that my request had not been carried out, and was told that there was nobody free to handle my call and that somebody would phone me back shortly. I was then contacted by an obvious new starter who was intrigued to know why I was complaining about the mis-selling of PPI when their policy was "Marvelous"
After explaining why, which took about 30 minutes as he failed to understand the fundamentals, he said he would look into it further. Three days later he confirmed that the only way PPI could be removed from my account was for me to set up a new agreement. When I asked for the settlement figure and what my new monthly amount would be I was shocked to find that the NEW monthly amount would be more than that I'm currently paying. As you can imagine I declined his generous offer, but did request it in writing. This has yet to materialise.
I then received a phonecall from the same person Saturday morning Informing that he had spent sometime going through my credit report and said that if I were to consolidate all of my Financial commitments in to one loan he might be able get me a better APR than what I'm currently paying. He also said that he was eager to meet his target for this month as he wanted to purchase a Hd DvD player and If i helped him, he would help me!!
Now before I go and make a complaint, and notify FOS, are lenders permitted to search your credit record with out your consent, If not what are they in breach of.

Nothing you have said I find hard to believe. They will stoop to any lenght to make profits.
If you have requested to cancel the ppi on the account. They must do this, I put a link on the forum regarding the FSA cancelling ppi and refunds. You do not have to take out a new loan and they cannot make you.
Now as regards to the young keen salesperson. sounds like a bit of a Maverick to me, just out of "lets rip our customer of to make profits and hit our targets, so I can get my commission, school".
Unfortuneately they can assess our credit files, they pay these credit agencies to store this information for their convenience. I think they can look at them, if you apply for a loan, to see if you are a bad risk, but I do not know where they stand, looking at your other accounts, to approach you for new business.
Disgusting practice, but now more than you would expect.

All is good, only 20 days now till myself and future Mrs badger get married so even HFC can't get me down.

Wow, getting married in 20days, congradulations, that is really good news, do be careful when you sign that agreement, that you know and agree to all the terms and conditions. LOL Once you sign it you are bounded forever.

They have also said that FSA guidelines do not apply as the loan was taken out over three years ago and there is an outstanding balance.
Of course they are not prepared to confirm anything this In writing.
Apart from bringing this to the attention of fos, which I will do to back up my complaint regarding the misselling of PPI, Is there anything else I can do?
I just don't have the time at the moment to focus on this due to my fast approaching wedding (2.5 weeks and still SO much left to do), any, and I do mean any help would be VERY much appreciated.

Nothing they say or do surprises me. I would make a official complaints to the FSA, and the OFT, and of course as you are going to the FOS. The FSA and the OFT will do zilch, but will give to a reference no and add it to the list of complaints, which is ever growing. Maybe even send a letter to your Mp, basically anyone that may listen.
Demand the ppi is cancelled and the loan reconfigurated to either reduced monthly payments or reduced term of loan. You do not have to take out a new loan with them, tell them this and that you are reporting this breach of the FSA guidence, it that they are not treatly you fairly, to the enforcement authorities. I have not seen any thing in the fsa guidence relating to the age of the loan. Ask them for written clarification of their statement, if in the event the claim went to court. Bet they don't address that issue.
Just keep at them and don't take no for an answer. But do not let it get you down, and spoil your wedding, there really is no rush to get these things done and they can take a while.
