    Default Urgent Help Bailiff Visit

Need some urgent advice please for my daughter.

She made an agreement for Council Tax which she has stuck to and is in fact £17.00 in front of the agreement.
bailiffsicon attended the property and her friend who is doing some work let them in, apparently didn't say who they were. They discussed the arrears with him and he thought he was doing her a favour and made arrangements for the arrears to be paid by 30th November.

Who can she complain to regarding them discussing her business with a workman, although a friend. They didn't check his status at all. What regulations have they broken.

    Any help will be appreciated.

hi surprise, take a look at what bailiffs can and cant do.
this may explain exactly where you stand.
i personally would have thought they would need to explain who they were ( even showing id). have a look at the link anyway and see if it helps.
    good luck.

Please note that although my advice is offered, you should consult your legal representative before taking ANY action.

    have a nice day !!

Update - letter received from Bristow Sutor regarding the data protection issue.

    Quote
Firstly, I would like to familiarise you with the Data Protection Act, this does not give you total privacy. It allows us to obtain information from third parties, including relatives and neighbours, when seeking to collect Council Tax arrears. We also have to sometimes reveal why we want the information or we can be accused of tricking people into revealing information that they may not have revealed if they knew why we wanted it. Furthermore, Section 29(3) of the Data Protection Act (1998) allows the exchange of information for prescribed reasons. It states that personal dataicon is exempt from the non-disclosure provisions in any case where the disclosure is for the assessment of collection of any tax or duty or of any imposition of a similar nature.

Are they right in what they are saying.

I am sure someone will come back soon and clarify but I am pretty sure that they have gone against the act in a major way - but need to check it out.

There will be someone who has the info at their finger tips. Please please keep a copy of the letter.

    I will post tomorrow
