Had second letter back basically telling me take a jump. car loan taken out in 2000 and was for 42mths. PPI added on in the normal you can't have loan without it. Advantage are saying ppi reclaim is not included in the new ruling cos it was before 2005 and My cause won't be investigated or excepted by the fos. Is this true? I am so confused about all this. I do have a copy of agreement I paid nearly 2 grand for ppi.
Yes unfortunatly it would appear to be correct. PPI only came under the jurisdiction of the FSA in January 2005 any sales made before then are not covered by the FSA rules and therefore can not be refered to the fos.
However this doesn't stop you taking court action.
I know someone that used the FOS for there PPI claim and the PPI was started in 2003 so maybe it depends on what are the reasons for mis selling. I would ring the FOS up and ask then relating to your case and see what they say. To be quite honest I can't see why they wont look into it you where forced into taking the policy out or you wouldn't have got the loan, how fair is that.
I'm waiting for my cheque to arrive for my mis sold PPI it took 4 refusels letters before they admited I had been mis sold. So don't give up.
The best thing to do is find out where you stand with the FOS and in the mean time follow all the procedures step by step for reclaiming PPI ready to take court action.
Reclaiming PPI from a car finance company wont be easy but don't give up.
