As you've gone to fos, I think you'll have to wait until they say they're finished with your case. They may still tell BC to settle your int't in full on top of chgs.
You may be on dodgy ground if you now go to court as they can say they offered to refund chgs in full and they were NOT obliged to pay any int't. You would then lose your court fees AND BC could claim costs from you I believe.
If you've not replied to BC offer yet, do so now with a letter from here - http://www.consumeractiongroup.co.uk...ng-offers.html - perhaps amended to accept the chgs refund but reject the int't element pending a final ruling from FOS.
I'd also write (a letter, not email) to FOS to say your not happy with the derisory int't figure and ask for them to consider making BC refund int't on top at 8% as would be ordered by Court.

Thanks mate. I did write to them refusing the offer and asked them to ask Barclaycard to explain the calcualtion of £4 interest when I made it £120 at 8%.
Guess I'll just have to wait now and see what happens, just find it annoying that nothing happens to them when they blatantly flaunt the Ombudsman, knowing damn well they'll pay in the end anyway

I've taken the Ombudsman route with Barclaycard. About 6 weeks ago I received an offer from Barclaycard for all the fees refunded but they offered £4 interest when the real figure is around £120. I declined the offer and wrote back to the Ombudsman. 6 weeks later and it's all gone quiet. I keep e-mailing the ombudsman asking if there is any further action I can take and how long they consider is fair for Barclaycards stalling tactics but all I kee getting is replies saying they are chasing it up.
Any ideas guys??
It may be that fos is swamped and ignoring em's or is being slow to respond.
Why not try a good old fashioned letter, sent by Rec'd Del'y and ask for a response within 14 days.
FOS may have decided that, because BC have made offer to refund in full, they are not obliged to pay ANY int't. This would be the case if BC refunded before you Filed Form N1 at court.

Hi Mate, I wrote to the Ombudsman last week asking them how long they would allow Barclaycard to drag this out before the considered it unreasonable. I also e-mailed Barclaycard offering them a week to settle in full before I too the court route. Ombudsman replied just saying they had a job lot of Barclaycard claims, all querying the interest calculation but they refused to comment on how long they would allow Barclaycard.
I also got a quick reply from Barclaycard saying that due to the 'seriousness' of my complaint it had been passed to a higher level, but the higher level still hasn't replied
