    Default mcfad vs Citifinancial

    just thought i'd start a thread to keep another of my PPIicon claims up to date

    1.June/july 07 - sent off SARicon but got back letter saying they had no info on me at all

    2.Aug 07 - complained to them as they are still processing my info in relation to payment history with CRA's

    3.Sept 07 - got told to F-O again

    4.Oct 07 - Complained to ICO

    5.Oct 07 - they magically found most of the info i needed within a week

    6.Oct 07 - On the bottom of the loan evaluation form (written at the time of taking out the loan and sent back to me with SARicon stuff) i've written 'i do not want to pay extra for this cover but i am being told i have to have it or i won't get the loan'

    think that should be enough to convince the fosicon or a judge but i'm not finished with them yet. i've also looked at the early settlement figures and they don't seem to be calculated in accordance with CCA(early settlements) so i'll tag that onto my claim too.

    just waiting for a bit more info from them n i'll get it sent to FOS or court.

    Hope this one is settled a bit quicker than my welcome claim

    re: welcome

    a defence was filed last week but wasn't signed and so was struck out by order of DJ but he gave them till 5th Nov to file signed defence.

    i'll post their full defence after 5th Nov

    some bits are easy to counter as the defence contradicts things they said in the correspondence we had before the case was registered at court.

    other points of their defence i've got good evidence to deal with too

    the only bit i'm working on now is that one point of their defence said i should be taking first group to court as that is who the policy is with. i've seen the arguement against this on the forum but can't find it. is it in SOGAicon?

    Could I ask when was the loan with Citi as I am also having problems with them (associates now cit) regarding getting my information.As they say thay no longer have it.

    hello

    it was 2003-2004

    they said they couldn't find any trace of me but were still sharing my info on payment history with CRA's so i made a complaint to ICO and info came within a week!!!


    not got it all yet , still waiting for payments schedule and interesticon calculations in relation to early settlements

    All I got was a payment schedule nothing else ours was 2001.

    I am going to write and ask for proof of destruction and if no joy there then that's another for information commisioner I have already got 3 cases with them going to report another 2 so that will be another to add to the ever growing list.

    I have a copy of the credit agreement (my own) so have the figures but there is just something not right re PPIicon and the settlement figure.

    I asked how all this had been worked out and they don't have any notes so we will see what happens.

    if the account still has money owing then i'm under the impression that Consumer Credit (Settlement Information) Regulations 1983 states that they have to give you details of how early settlement is calculated but not sure if no balance owing.

    i think i'd get your case registered at court just to stop it getting barred under six year rule.

    First loan was for £8685.10 of which £2585.10 was the PPIicon 02/01
    This was then refinanced into a secured loan the following month of which £4703.00 was PPI added to the loan 03/01 the loan was paid in full in Nov03

    I really needed the information of how the 2 loans were calculated as I am not sure if there was any rebate of insurance from the first loan as ther was a rebate of insurance of £869.44 when the loan was settled.

    So they basically got £42,965.62 for a loan of £25,102.47 in just 32 months.
