Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I've sent ym DPA request off with my cheque. I'm gonna take this one slow though guys coz I;m in the middle of a claim at the mo and wanna get that one sorted first. Just interested to see how much ltsb have charged me.
You are right to take it steadily. Being methodical in your approach should keep any claims running smoothly.
For each account it's a good idea to find out what has been taken and then take a view on what you want to do with that information. For example, you can prioritise which accounts to claim on first based on their value, interest rate, or hassle-factor.

I am currently persuing a claim with HSBC and have just the DPA to Egg as well, I'm collecting all information from as many accounts as poss, so we'll see.
I am at the lba stage with HSBC - jsut actually sent it today, so they've got 14 days to reply and offer me a settlement!! Fun, fun, fun!

Well, sent my DPA request to Lloyds with the cheque. They received it 22.06.2006. It's been a week now and still not heard anything - can I start the 40 days from the date they received it because I've got recorded delivery proof? Or do they actually have to cash the cheque first?!
I believe you can count the 40 days from when they receive your letter. The £10 fee is the statutory maximum and they may or may not choose to take it. Sometimes they do, sometimes they don't.
In my DPA letter I gave authorisation for them to take up to £10. They sent the information on my current account at 18 and 20 days (in two batches) and they debited my account by £10 just afterwards. My credit card info requested on the same DPA letter arrived at 43 days in a torn brown paper envelope, with my personal details open to view.
For both current account and credit card, I prompted them after about 14 days, to help them meet the deadline as it is in the interests of both parties to make sure this happens. If you choose to send them, you may wish to emphasise to the bank in your prompting emails that they are required to send your data in a protected fashion (e.g. well packaged) - this is under the Data Protection Act after all. Presumably the encompassing Freedom of Information Act means freedom of information to you, the person they hold information on, not freedom of information to all and sundry.

When you say a list of manual interventions, what exactly does this list say?

There is a list of explanatory notes too, this basically means that a Mail Out (MO) of a standard letter (STDLET) was sent to me on that date. I think thats my statement as there are loads of these. There are a couple indicating when I opened my account and also when I closed one of my other accounts.
Does this help?

Just an update - Lloyds received my prelim MOnday 07.08.2006 and I got a reply today, you know the usual fob-off letter "I'm sorry you have made a complaint, we will get back to you in 18 months!" lol.
Now, my question - they have been quicker than I thought and my first deadline expires 21.08.2006. Should I wait until this date? I was reading through this forum yesterday (well, I do everyday - seems to be all I do online now, whcih I don't mind at all!!!) and it clicked to me that we actually give the bank(s) 28 days to sort it our amicably (14 days first letters + 14 days second letter). Is this significant or should I issue them with the lba now?
I know people seem to haev different views on this and I am tempted to leave it, however I am just impatient and would rather get this over with asap. It's the whole court thing though - would a judge look unfavourably if I haven't given them the FULL 28 days to think about it? Or is it sufficient to act on their reply.
I was just thinking that, if the role was reversed they would guive us 28 days to reply, but once we have replied they can issue the next steps can't they? I would have thought the 28 days just gives them enough time to reply but once they have replied the deadline can change?
I didn't have this problem with HSBC - they replied to all my letters one day before the deadline, so I just waited, lol.
Any thoughts?
Thanks guys.

Wait the time you gave them 14 days between each letter, stick to your deadline thats the deadline you have set so i would stick to it.
