Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I posted the following in the Egg forum, but as yet no-one has replied. I'm hoping someone here could give a bit of advice...
"I've got a query, which I haven't really been able to find definitive info on.
Back in 1998 I applied for a Boots Advantage credit card, which eventually got changed into a green Egg card, then a blue card. When the boots card got changed to the Egg Blue card, a new account number was issued for the card, and the original settled and closed (by them) - balance transferred.
I requested a copy of my CCA from them earlier this year, and received a copy similar to the ones floating around this forum. I thought nothing of it, and put it to one side. However, yesterday, looking through my details, I noticed that the CCA they sent me has the original account number written at the top (the settled one), and no CCA sent for the account number which is still defaulted (do I make sense??).
My query is this... does this CCA apply to the newer account (different account no) as well as the original, or should there have been a new CCA for it when the old one was settled?"
I don't have access to a scanner this moment, but will probably be able to tomorrow. I'll post it up then.
In the meantime, what they basically sent is as follows:
Advantage Card powered by Egg Agreement created for "me", with original date on it (2000).
Further down it has my name and address, Eggs postal address, Limits (We'll let you know...blah, blah, blah), APRs, Repayments... basically everything that should be on an agreement.
However, the account number is handwritten at the top in pen I presume, and is the number that according to my Credit report is settled and closed.
There is nothing for the card which shows as defauled in 2005 (a different account number - close to the original number but no cigar!)...Egg automatically settled the original account and transferred the debt to the new account. No agreement signed for new defaulted account.
This will probably become clearer when I've posted it.
Also, have a copy of my credit report, which shows the original account (this agreement) as settled, and the second (bizarrely with the same start date) as defaulted:
The defaulted account number, I have just found out, bears absolutely no resemblance to the number on the agreement (1st one starts 4910, the second starts 5186).
So, the question remains... can the above CCA cover the second account despite completely different account numbers?
(Apologies for the quality - I've had to scan Egg's fax - not the best images in the world!!)
I will get back in touch with Humpty (or should it be with Credit Solutions-they are now the DCA?) and have a word with Experian about it...nothing ventured, as they say.
