    Default What next

    I started my claim a long time ago last year and then I read lots on this site. However I am a bit rusty now and would like some info. please. My claim is against RBSicon for a total of 7087.05.
    1506.76 being charges, 5330.29 being contractual interesticon and 250 court fee as I completed MCOL 30/03.
    Some months ago I received an offer of 1807.35 from Cobbetts on behalf of RBS. I cashed this cheque and spoke to the court as they(Cobbetts) were asking me to sign a notice of discontinuance stating that my claim for interest would be unsuccessful anyway. Courts stated that it was my choice but that unless I was going to discontinue my claim that they did not require anything from me.
    I have received a letter from the court dated 3/10 which encloses a pre-trial checklist(how do I complete this??) and adds that there is a listing fee of £100 and a hearing fee of £500. But I have already paid the MCOL fee 0f £250???
    Cobbetts have sent me a letter stating that they will write to the court seeking an order that the rest of the claim be dismissedicon.
    When do I prepare the cort bundle and when is it sent to the court?
    Will I have to pay the additional £600
    Help I'm in a right pickle and as I am planning to get married next year I can do without shelling out £600 which I have not got

    Contractual interesticon is one i would personally avoid as it will most likely end with you losing your case like so many others.

    Hi everyone, I have been away for sometime now but I am back and ready to continue with my struggle to get what is rightfully mine. The last mail I received from Halifaxicon advised that as a result of the pending test case they cannot and will not doing anything with regards to my claim for charges which total over £6000 excluding interesticon charged. I must confess their letter has bothered and confused me. Please I need help on what to do next and also since the amount I am claiming is over the limit handled by the small claims court, what other options can I follow?

    Hi, Joemarket,

    You can still issue a county courticon claim against the Halifax, if u have the funds. The case will most likely be stayed, (suspended) until after the OFT case, but you can add 8% interesticon from the time you start the claim until the date of your trial. When the case eventually gets to court your claim will be worth more!

    I understand your concerns about the claim being over £5000. Personally I wouldn't risk it being sent to the fast track and would split your claim into two parts, there is no rule against this. For e.g. you could knock off one year of your claim and the claim may be reduced to £4500. Claim for this amount and leave the rest of the claim until a later stage.
