    Angry unauthorized credit searches I'm LIVID

    About 2 months ago my wife and I applied for a secured loan with Igroup through a loan broker. no probs there we just decided not to proceed.

    On Thursday my wife recieved a cold call from Central Capital Ltd, who asked my wife if it was ok to search MY credit file. She said it was and the girl on the phone performed a full credit search on MY file and openly discussed MY outstanding credit balances with my wife ( I was totally unaware of this and when I found out I was not best pleased!!!)

    Then yesterday the wife received ANOTHER cold call from Welcome finance offering another secured loan. Wife told them under no uncertain terms to BOG OFF!

    I have just checked my credit file online and both Central Capital and Welcome Finance have performed credit searches on my file (application type: secured loan). I cannot describe how angry I am about this and i wan't to take this as far as I can.

    Can anybody on here please advise the best way to proceed.

    Hi,

    When you go through a broker you normally agree to them passing on your details to relevent companies to find a ' suitable ' loan which then means those companies that you have been referred to can search your credit file. You should check you paperwork for the broker about this but certainly central capital should not be discussing your details with your wife without authorization.

    As you originally applied for a joint laon you more than likely gave your permission to discuss and search your data then. You will now get 100's of phone callsicon and letters on the same subject.

    I only ever gave Igroup permission to search my file, Central Capital and Welcome Finance are not connected to Igroup in any way.

    When Central Capital called my wife they asked her for permission to search MY file. surely they have no rights to do this without my authority.

    As for Welcome finance they have performed a credit search without any dialogue at all.

    Admittedly, I really dislike Welcome finance (purely from stories I have read on here and from family and friends) I wan't to take this as far as I can. just wandered where to start.

    UPDATE -

    Welcome finance have today performed ANOTHER credit search on my file (remember I have not spoken to them at all).
    I have called the Information Commissioners Office who advised me to write to them and send copys of the letters to themselves.

    Wonder how many people have their credit reports tainted by these unauthorized searches.

    Make sure the ICO obtain evidence of your approval for the search, there obviously is not any to be found, but it does save you having to pay £10 for a Subject access requesticon to a company you had no dealings with.

    As for the mail, they have possibly bought data from the broker so registering with the Mailing Preference Service might not stop it. A simple way to get the message to them is to use their prepaid envelope to send their rubbish back saying "not interested". If they still fail to understand then you can always destroy any name or reference to you and post them a heavy package in the prepaid envelope. Yes I hate junk mail!

    Try not to worry too much because the searches automatically disappear off your file after 12months, the down side to this is that when you really need financing then a search within the 12 months by another finance company will be able to see those searches done previously, then they assume that you are stuck for money and are shopping around for a loan.

    Too many credit checks gets finance company wobbling because they assume that you are strapped for cash and need credit.

    Ask the Compliane office at both the credit companies to delete the information from the system, also write to experian and equifax, although if you write to one company they have an agreement to share the additions and deletions in the interests of accuracy.

    But do relax i know how livid it can make you... i was one of those livid people.
