hi all
i am trying to claim back nearly £5000 from a&l for the last 6 years of charges.
i have already sent letters asking etc, and have now made a claim through mcol.
i received the norm letters from wragg ?& co and am wondering what i need to do next .
i did not send a copy of all my staements etc to the court so do i do this?
also how or when do i ask for it to be moved to a court near me. i did notice that my locl court is not on the list as 1 of the 1 who gets the case to stay. just wondering where do i go now
any help is much needed and gratefully received as im so stressed with doing this.
Did you use the step by step instructions on here?
Which Particulars of claim did you use as there are new ones in the "sticky " threads at the top of the A&L forum.
All cases through MCOL are automatically stayed anyway .
So You probably wont have to send your statements yet anyway ( normally you would do this when transferred to local court.)
You will be in for a wait while the test case is pending by the looks of it.

thanks for repling
i have already sent letter asking waited 14 days got reply back blah blah no u cant have the money
then i got a letter saying about test case , and thought right, just take to court so i applied to court by mcol, i have had like the defence stuff from wagg & co and i am just waiting now. then they said a few days later oh we are closing your account and said in other words pay back overdraft now.
not sure of wat to do know and wondered if i should send my statements etc to the court or just wait till it gets moved to my local one

every ones in the same boat here and its amazing how many , these banks have prob made millions from all the people who have past the 6 yrs rule aswell its criminal really

If they have closed your account you should make a complaint to the fos. They are still dealing with complaints for account closures. You should also make a complaint to the FSA as this was precisely one of the reasons for invoking the waver to stop banks from taking retaliatory action. The FSA are currently reviewing the waiver so any evidence of the banks flouting the waiver agreement mwy result in the waiver being lifted.
You do not send your statements to the court just your schedule of charges.

my letter of defence from wraGG & CO was dated the 1st oct, and then i received a letter frm northampton court to say they are wagg i mean are defending and thats all i have had so far
when reading through some other people defence letters mine is much the same maybe 1 or 2 different sections but mostly the same.
will i send my schedule yet to northampton or wait.
as i noticed my court is not on the list where they just get them to stay , but reading some others ive notice ive prob got a long wait
As you filed through MCOL once the defence is filed it is automatically stayed. You should get confirmation of this in the next few days. If you write to them and ask them to transfer it to your local court they will do this but you must request it otherwise it will remain with MCOL. You can send off your copy of your schedule with your letter of request for transfer and it will be added to your file when it is transferred. You will also need to send one to Wragg & co.
sorry to hi-jack the thread but wondered if you ha seen the thread from "annoyed" on this forum.
Thought the statement of how he had re-claimed his monies maybe of importance and relevance for other hardship cases?

ive just got my letter of stay mind you its dated the 4th oct.
i cant seem to find the link where you had a letter template to send to ask for the stay to be removed and to get it sent to my local court
please can you help
