Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
just after general advice on a couple of points. Already started reclaiming against the Halifax however, I need to clarify the following :-
1) Since 200, have also had an aco**** with TSB, can't remember account number or sort code, can i DPA these and get that info?
2) Also had an account with HSBC, this account is now in the hands off debt collectors due to me having to take unpaid time off for personal reasons. I intend to pursue them for charges, can i get the debt collection co to stop the attachment of earnings they have on this whilst undertaking action against them? Also, how would payment re the above be made? Would it be paid directly against the amount I owe them, or would they pay by cheque.
Point one - What I did was to send the DPA letter, add a section stating that you are unsure of the account number etc. Enclose the address you was at when the account was active, along with you date of birth and send a utility bill and a photocopy of passport/driving licence.
This then covers all angles.
Ensure you state that you require all documents to be returned as soon as they have been checked and that all letters should now be sent to your new addess.
Should do the trick!
Hopefully someone will be able to assist with point two!
