    Default We've been Gazumped - and lost £££ :( Please sign my online petition!

    Chaps...

    After spending quite a few quid on the initial stages of a house purchase, we were Gazumped at the final stages. We lost the house we were buying, not to mention the money we had already spent on searches etc.

    What can we do?
    Absolutely nothing, because in this country it’s legal for it to happen. As buyers, we have no protection from it. It’s as simple as that.

    It’s a risk that anybody buying a house will face, and something that causes a great number of people to lose money to on a daily basis.

    We have to accept the fact that we can agree a deal, then pay for searches, surveys and more, but at any time, the seller can simply change their mind just because he feels like it. The buyer swallows the loss and the seller walks away having lost nothing!

    ...so back to square one for us albeit slightly lighter in the pocket and in 2 weeks time, if it wasn’t for good old mum and dad, I’d basically be homeless!

    Having fallen victim of this Gazumping practice, I submitted an online-petition to the Government. I am pleased (...and somewhat surprised) to say that it's been accepted!

    Maybe with a bit of support it might be possible to change things for the future… Who knows, but it’s certainly worth a shot!

    If you get a free minute please take a second to read my petition - It's not only from a buyers point of view, but takes into account the sellers position too. My suggestion just makes things fairer on all accounts.

    Whats this new homebuyers pack (whatever its called) does that not include such things as surveys etc?

    I am happy to offer helpful advise in many consumer problems based on my retail experience. I do not represent any company, and any advise I do offer is my opinion and how I understand the law. I have no authority to create any terms for any company I do work for and will just nudge you in the right direction without breeching their trust.

    Signed - dastardly behaviour. How about someone who has made you an offer on your house and then when you have placed an irrevocable bid at the property auctions on the house you wanted, suddenly you see your buyer at the auctionicon . The estate agent (who was party to the auction and our sale) later told me they were time wasters!!!!!!!!!!!!! Cost me £500 a few years ago.

    Yes there is.

    Agree a contract with both your solicitor and the seller's solicitor that you will be reimbursed for your costs associated with the seller pulling out should they accept another offer.

    Totally agree - It's so simple but why do we have to do this!?????
    Some sellers won't agree, some buyers won't know to ask for it...

    It's such an obvious flaw in the system, and it needs to be addressed, hence the petition!

    Sorry about your experience.

    It's never happened to me but if it did then I would consider doing as I suggested.

    If a seller is intent on selling and is serious about your offer then it would raise questions for me if they didn't want to agree to this.
