Hi there, this is my first post so hopefully i have put it in the right section. I am currently having a problem with Barclaycard, please bare with me as it is a little complicated but i need some advice.
I applied for a Barclaycard in 1998 and was accepted, i had no problems with managing it until 2002 when i became ill with Depression, and got behind on payments. After missing 3 payments barclaycard had passed the account to mercers, which from reading the forum they are a part of Barclays, i never knew that. Anyway... i was admitted to a mental health hospital in 2002 with a Breakdown. As i was very unwell my mum had permission to deal with all of my debt. So she contacted Mercers amongst others and explained the situation. They all required a letter from my GP confirming that i was in hospital. Once this had been provided Natwest (which was another of my debts) agreed to put my account on hold till i was well again, which was fine, 1 year later when i was all better Natwest contacted me about the outstanding debt which i paid off to them in full. Mercers agreed to wipe off the £301 that i owed as they did not want to add to the stress i was already under. They confirmed this in writing to my mother.
My apologies if this is going on, i just want to give the full picture...
In 2004 i applied for another barclaycard and was given another one with a 1000 limit. I do not use the card anymore i am just clearing the balance.
As i have very poor credit rating i thought i would check to see what my report was like, so i applied to equifax and recieved it in the post yesterday. And on my account amongst other things, it shows my current barclaycard account and also a barclay card credit card account which i opened in 1998 with an outstanding amount of £301, and to top things of they gave me a default too in May this year!
I called Barclays about this and they said that even though Mercers wrote the debt off 5 years ago, they then passed it back to Barclays, and as i have not paid anything they have put a default onto my account. As i pointed out to them, that over the last 5 years i have never recieved any correspondance from them over this closed account and have certainly not recieved notification of a default. They said that yes the default is a little unfair but the good news is they havn't charged me interest for the past 5 years!! I really need some advice on how i should deal with this, as this account was not on my report in oct of last year when i last checked it, as far as i was aware it had been closed my Mercers, though unfortunately i do not have any of the letters or details of this account anymore as it was from 5 years ago. I also do not understand how i was given another barclaycard in 2004 when they are saying that i owe them money on this old account still...
I hope that isn't too confusing, any advice would be really gratefully recieved.
Sorry you haven't had a reply on this Lottie, I think I would put your complaint in writing to Barclaycard and then after they have taken the usual amount of time to get back to you, you can complain to fos, you'll need to get any paperwork in order to send to them but couldn't quite understand, do you mean they are still chasing you for the alleged debt?
Unfortunately, Lottie hasn't been back on site since Nov 2007. Sorry this got missed at the time.
It seems wrong that the default was placed so long after the a/c was "written off". I suspect, however, that it would be difficult to have it removed as it may have been properly placed, albeit very late.
As the debt was written off, Statute-Barred doesn't come into it, although it would have been relevant 6 years after the last pay't was made to the a/c.
